Terms of service

Conditions of use for Gesto and the terms of the SMS and WhatsApp messaging program through which payment instructions are sent to account holders who authorize it.

01Purpose and acceptance

Gesto is an AI voice-agent platform for managing and recovering past-due portfolios (www.gesto.com.co), operated by T-Systems LLC, with its principal place of business at 1000 Brickell Ave, Suite 715, Miami, Florida, United States ("Gesto"). These terms govern the use of the website, the use of the operations console by client collection entities (the "operators") and the messaging program described below. By using the site or the service you accept these terms. Each operator's commercial conditions are governed by its service agreement, which prevails over this document in case of conflict.

02Use of the service

Console accounts are personal and non-transferable; each operator is responsible for the confidentiality of its credentials and for the activity performed with them. The service must be used only for legitimate collections management, on portfolios owned or duly entrusted, in compliance with Ley 1266 de 2008, Ley 1581 de 2012 and Colombia's consumer-protection statute. It is prohibited to use the platform for harassment or abusive contact, to upload personal data without legal authorization, to attempt to access other operators' data, to interfere with the operation of the service or to reverse engineer the platform.

03SMS and WhatsApp messaging program

Gesto sends text (SMS) or WhatsApp messages only to account holders who verbally authorize it during a recorded call. Messages contain the instructions and secure payment link for the agreement reached on that call: a maximum of two to three messages per agreement, transactional in nature. Gesto does not send marketing or advertising messages through this channel. Message and data rates may apply depending on the holder's mobile plan. The authorization is recorded together with the call recording.

04Help and opting out (HELP / STOP)

Holders can reply HELP (or AYUDA) to any message to get assistance, or STOP to immediately stop receiving messages. A STOP opt-out is applied automatically and permanently for that number. Help or opt-out can also be requested by writing to [email protected]. Opting out of messages does not modify the obligations of the payment agreement; instructions will be delivered through another channel.

05Privacy

The processing of personal data associated with the service, including the phone numbers messages are sent to, is governed by the Privacy and data-processing policy available at www.gesto.com.co/legal/privacidad.

06Limitation of liability

Gesto provides a technology service for collections management on behalf of creditor operators. Gesto is not the creditor of the obligations being managed: payment agreements are entered into between the account holder and the corresponding creditor. The service is provided with reasonable availability levels, without a guarantee of uninterrupted or error-free operation. To the extent permitted by Colombian law, Gesto's liability toward the operator is limited to what is agreed in the service agreement. Nothing in these terms limits non-waivable consumer rights or liability that cannot legally be excluded.

07Governing law

These terms are governed by the laws of the Republic of Colombia. The collections operation is subject to the oversight of the Superintendencia de Industria y Comercio (SIC). Any dispute will be submitted to the competent courts of Colombia. Before resorting to other instances you can file a claim directly by writing to [email protected]; we will respond within the legally established timeframes.
